You have rights. First of all, your neighbour cannot dig up your land without your permission. This is a violation of your rights as a property owner. He should have approached you and entered into an encroachment agreement with you, for which you would have been within your rights to negotiate financial compensation. However, the digging has already happened. The City may be able to stop/pause the construction work. We would recommend contacting your local municipality’s building department (just Google “your city name building department”) and ask them what measures and remedies they may be able to offer you.
